I, the artist, retain all rights to the commissioned artwork. You are purchasing usage rights, not ownership of the artwork itself.
I may use the artwork to:
Promote myself and my services Post on social media and in my portfolio. Create prints/merchandise (for fanart commissions only).
Exceptions:
If an NDA was purchased, the artwork will not be posted or used for promotional purposes.COMMISSIONER RIGHTS
You may:
Use the artwork for personal purposes only (unless commercial rights are purchased). Print the art for yourself. Post it on Social Media with credit to me " @Loretecks ".
You may NOT:
Use the artwork commercially without permission. Commission art/services using my Design/Work. Claim the artwork as your own or fail to credit me. Remove signatures/watermarks. Resell or redistribute the artwork. Modify the artwork without my consent. Use artwork purchased for Personal Use in merch, streaming, or commercial projects.GENERAL
-When sending payments via PayPal, DO NOT send it via the "Friends and Family" option. Payments are expected to be sent via the "Goods and Services" option. Please remember to click "no address needed", and in the note please just include your social media handle, and nothing else!
-I reserve the right to decline a commission at my discretion.
-I accept full payment upfront before any work is to be done.
-All payments must be made through the agreed upon platforms.
-I may accept a payment plan at my discretion and take half the payment upfront and the other half when the work is completed. If I agree to a payment plan, I will not provide the finished product until I receive the full payment we agreed upon. I reserve the right to decline any requests for a payment plan.
-Commissions are for personal use only unless agreed to and commercial rights are purchased. My art may not be used for profit without prior agreement and consent from me. Examples of personal use are (but not limited to): Profile pictures, icons, posting on social media WITH CREDIT, printing for yourself, banners.
-Under no circumstance is my art permitted to be reproduced or used for merchandise. This means my art is not permitted to be sold by anyone but myself without my explicit consent in any way, shape, or form.
-Use of my art in AI in any way, shape, or form is strictly prohibited. This means my art is not permitted to be run through any AI mediums like (but not limited to) ChatGPT, Sora, Grok, etc.,. This applies to past, present, and future work(s).
-Use of my art for Crypto/NFTs in any way, shape, or form, is strictly prohibited.
-Under no circumstance are you allowed to edit or modify any of my work without my explicit consent.
-If you request an NSFW commission and are wanting to include someone else's character, you must have EXPLICIT consent from every other party involved. I will not proceed with the commission otherwise.ADDITIONAL FEES
-Any need for additional fees and rates are decided at my discretion.
-All fees are determined at my discretion.
COMPLEXITY FEE: All commissions provided by me are subject to a complexity fee ranging between $5USD - $100USD.
DESIGNING FEE: If I'm expected to create and/or design anything for your commission without explicit guidance or reference(s) (examples are (but not limited to): character designs, outfits, accessories, weapons, significant changes to an already existing design, etc.,), a designing fee ranging between $5USD - $100USD will apply.
REVISION FEE: Any changes requested that weren't mistakes on my behalf are subject to additional fees depending on complexity. Any changes requested after the prior phase(s) has been approved by you are also subject to additional fees depending on the severity of the requested change. Revision fees range between $5USD - $100USD.
RUSH FEE: If you expect a commission completed by a specific date I reserve the right to charge a rush fee depending on how soon you expect it. I reserve the right to decline a request for a rush order at my discretion.
NDA FEE: If you would like a private commission please state so during the ordering process. A private commission means I will not post or share anything concerning the commission you purchased from me. All details and WIPs will be provided to you and only you for you to show at your own discretion. An NDA fee is a flat fee of $100USD.
COMMERCIAL FEE: If you are intending to purchase a commission from me for commercial use, this must be stated before any other transaction occurs. (Commercial use includes (but is not limited to): Business cards, business promotion, exclusive patreon content, website assets, etc.,). A commercial fee is a flat fee of $80.COMMUNICATION EXPECTATIONS
-Communication during the commission process is very important. If I reach out to you during the process and you do not respond within one week, I will accept the lack of reply as approval to move on and continue with the art as it is.
-You are permitted 2 free revisions during the sketch phase per commission. Additional revisions are subject to a revision fee decided at my discretion, and must be paid before I continue with the commission. Revisions are only available during the sketch phase. Once sketches are approved, no further changes will be made unless due to an error on my part. Mistakes I make will always be corrected at no cost.
-I need clear, visual references of what you'd like drawn. If you do not provide appropriate references (examples are (but not limited to): verbal/word description only, sketches with no digital color swatches, etc.,) I will charge an additional designing fee.REFUNDS
-I may accept refund request(s) at my own discretion. If I've already gotten to work on your commission, you are not entitled to a full refund. I will keep the funds equivalent of the work I've already done. This is not negotiable. The amount I keep will be determined by me.
-I reserve the right to decline a refund requested by any party(s) involved.BLACKLIST POLICY
Breaking these rules may result in a permanent public blacklist (with evidence).The blacklist may be shared with other artists.FINAL AGREEMENT
By commissioning me, you acknowledge that you have read, understood, and agreed to all of the terms above.

-You may trade or resell designs purchased from me, HOWEVER, you MAY NOT resell the design for more than you bought them for unless you've gotten paid commissioned work of the design in question. The price of the design must not exceed the overall cost of the commission(s) purchased and the amount paid for the design.-You may not resell a design that you got in a trade from me UNLESS you've gotten paid commission work of that character. The price of the design must not exceed the overall cost of the commission(s).-If I agree to trade a design in exchange for art, you have until the negotiated time limit to complete the art. The design(s) in question will be put on hold until the art is given to me. Failure to complete the art and give it to me will result in me putting the design(s) back up for sale. Failure to complete the art to the agreed specifications (example; we agree that you will draw a full-body colored art piece as payment and you provide me with a half-body colorless art piece instead) will result in the art in question being treated as a gift, and me putting the design(s) back up for sale.-You must credit me as the creator of the design. You may not claim to be the creator of the design.-Payment is expected upfront. If you do not pay within 48 hours of my response to your purchase inquiry I will put the design up for sale again.-I do allow holds. My typical maximum timespan is two weeks! If you do not pay within the given timespan I'll put the design back up for purchase.-Once purchased you will receive the full reference sheet with my watermark moved to a more convenient space, and if the design was purchased on Toyhouse, the character permissions will be transferred over to you!-I accept payment through PayPal and occasionally through DeviantART points! IF YOU ARE PAYING WITH POINTS WAIT UNTIL I TELL YOU TO PAY AND DO NOT JUST GIFT THEM TO ME. I WILL OPEN A COMMISSION WIDGET ON MY PAGE FOR YOU TO PAY THROUGH. POINTS SENT ANY OTHER WAY OTHER THAN THE WAY I INSTRUCTED WILL BE TREATED AS A DONATION.-They're your design now! Redesign them how you like. :>BY PURCHASING MY DESIGNS YOU AGREE TO THESE TERMS.FAILURE TO ABIDE BY MY TERMS OF SERVICE WILL RESULT IN YOU BEING BARRED FROM PURCHASING DESIGNS FROM ME IN THE FUTURE.ANY ATTEMPT TO RESELL MY DESIGNS IN ANY WAY THAT GOES AGAINST MY TERMS OF SERVICE GRANTS ME THE RIGHT TO RECLAIM THE DESIGN AND DO WITH IT AS I SEE FIT.(The reason I will treat points sent incorrectly as a donation is because DeviantART will flag my account for suspicious activity if points are sent in any way they deem suspicious. Points being sent to and from people, then used for a premium download/commission purchase can be flagged as suspicious activity which may result in them voiding the transaction, and me not receiving the rightful funds. Multiple flags may result in me being permanently barred from making a profit in such a way/have all my pending funds confiscated from me.
